Governors, National Govt in epic clash over crucial law

A storm is brewing between the Ministry of Agriculture and county governments over the proposed Pest Control Products Regulations, with Governors accusing the ministry of sidelining them in the formulation process.

Appearing before the Senate Agriculture Committee, the Council of Governors (CoG) flatly rejected the regulations, citing lack of public participation and consultation.

Council’s Agriculture Committee Chair and Bungoma Governor, Kenneth Lusaka, criticized the ministry for bypassing county governments despite agriculture being a fully devolved function.

“Counties are expected to implement these regulations, yet the ministry completely ignored their input. Many of the provisions are not only impractical but also infringe on county mandates,” Lusaka stated.

Senate Agriculture Committee Chair, Mwenda Gataya (Tharaka Nithi), echoed the concerns, warning that the Senate may be forced to annul the entire set of regulations.

“Engaging key stakeholders is not optional. It is a constitutional requirement, especially on matters that directly impact devolved units,” said Senator Gataya.

Governor Lusaka further urged the Ministry of Agriculture to always consult the Council of Governors when dealing with devolved functions to ensure seamless implementation and long-term success.

The standoff now sets the stage for a possible regulatory rollback unless consensus is reached through renewed stakeholder engagement.
